JUDICIALIZAÇÃO DA SAÚDE: O CAMINHO DO JURISDICIONADO AO TRATAMENTO EXPERIMENTAL

Abstract

O presente artigo aborda o tema da judicialização da saúde no que tange a busca do jurisdicionado por um medicamento ou tratamento em fase experimental, tema complexo dado o bem jurídico em jogo: a vida. Para abordar tal tema, se fez necessário traçar um comparativo da judicialização da saúde e os princípios constitucionais envolvidos, dissecando-o de modo a encontrar uma solução para questões que envolvem os medicamentos ou tratamentos experimentais, pontuando erros e acertos do judiciário na ponderação de princípios ao julgar o tema, tanto no âmbito público quanto privado nos casos em que a busca pela cura por meio de um tratamento de eficácia duvidosa pode expor a vida em risco, o bem jurídico em questão a ser tutelado.

This article deals with the topic of the judicialization of health in the search for the jurisdiction of a drug or treatment in an experimental phase, a complex issue given the legal good at stake: life. To address this issue, it was necessary to draw a comparative of the judicialization of health and the constitutional principles involved, dissecting it in order to find a solution to issues involving drugs or experimental treatments, punctuating errors and correctness of the judiciary in weighing principles when judging the issue, both in the public and private spheres in cases where the search for cure through a treatment of dubious effectiveness may expose the life at risk, the legal good in question to be protected.
