SELF-EMPLOYED WORKER WITH RIGHTS

Abstract

This study analyzes Complementary Law Project No. 12/2024, which seeks to regulate the work of app drivers in Brazil. The research uses a qualitative approach, based on the analysis of legislation, judicial decisions, and doctrines on the recognition of employment relationships. Comparing the project with Law No. 13.640/2018, the study identifies advances in labor protection but highlights gaps regarding algorithmic control and subordination. It concludes that, while the project represents progress, it still does not fully address issues of autonomy and working conditions.
