Abstract
This article addresses the need to maintain the concept of refugee as established by the 1951 Convention Relating to the Status of Refugees, together with its 1967 Additional Protocol, especially with regard to political persecution, given that it may imply the loss of legal protection for those to whom the aforementioned regime is intended. Bibliographic and documentary research was carried out in order to analyze the need to maintain the conventional concept of refugee in view of the new nuances given by the doctrine and the international community, using dialectical and systemic methods to analyze the data collected. It is clear that political persecution causes a large international migratory flow, which demands specific protection through the granting of refuge to the victims of such persecution, who may face resistance from States or even loss of refugee protection in view of the expansion of this concept.
