Abstract
The objective of this paper is to outline the main legislative characteristics regarding the handling of the chemical agent benzene in the work environment, bringing the constitutional protection itself to the professionals who are obliged to work with this agent, whose health damages result of the prolonged exposure itself. The legislation imposes compensation, but does not incorporate any monitoring practice, since the hypothesis raised is precisely the absence of protective public policies when it is found permanent damage to the health of the worker. Through the deductive methodology, anchored in doctrines published in physical and digital media, we try to validate the presented hypothesis.
