Abstract

The study focuses on investigating the binding force of resolutions, declarations, and recommendations in international law, since there are still doubts regarding the coercive effect of these international normative documents. The objective is to demonstrate the necessity and feasibility of reformulating the applicability of international law sources by proposing the recognition of resolutions, declarations, and recommendations as coercive, thereby strengthening the legitimacy and effectiveness of international norms. This is a research project with a structuralist and positivist approach, utilizing a descriptive and deductive lens, with the collection of documentary and bibliographic data. It draws on official sources from governments and international organizations, scientific article databases, repositories, and legal doctrine, analyzed in a critical-narrative and descriptive manner. Preliminary results suggest that reevaluating these instruments as primary and binding sources appears to be feasible.
