SUPERINTENDENCE OF GOVERNANCE, RISK AND COMPLIANCE OF THE PORT OF SANTOS AND THE ESG MANIFEST

Abstract
In this article, the authors aim to discuss the values of ESG (Environmental, Social, and Governance), especially regarding its implementation within the port sector of Santos. Notably, the Port of Santos plays a leading role on both national and international stages, with the potential to positively influence other national ports. Thus, this essay will cover the presentation of environmental, social, and corporate governance values; an analysis of whether there is a specific body for implementing these values in the bylaws of the Port Authority of Santos; and, above all, whether the competent superintendence has been efficiently fulfilling its legal/regulatory duties. Additionally, it is essential to recognize the existence of various efforts carried out by the Superintendence of Governance, Risk, and Compliance of the Port of Santos, with particular emphasis on the voluntarily signed ESG MANIFESTO, which serves as soft law by various port stakeholders.
