Application of the Principle of Insignificance to the possession of drugs forpersonal use

Abstract
The present study aimed to address the possibility or impossibility of applying the Principle of Insignificance to the crime of drug possession for personal use, except for marijuana. It is an exploratory study of a bibliographic and documentary nature, involving bibliographic/documentary research and employing the technical-legal method of analysis. The analysis was conducted based on the case law of the Higher Courts, enriched with various doctrinal perspectives. This article highlights the relevance of the topic in light of recent jurisprudential changes, particularly the judgment of RE 635.659 by the Brazilian Supreme Federal Court (which decriminalized marijuana possession) and the recent Proposed Constitutional Amendment (PEC) 45/2023 (currently under review by the Chamber of Deputies). The study observed discrepancies in the criteria used by case law to determine whether the principle applies to the offense in question, underscoring the need for standardization.
